These Terms and Conditions (“Terms”) govern the use of courier and logistics services provided by Eira Shipping Logistics (“Company,” “we,” “us,” or “our”) to all customers (“Customer,” “you,” or “your”). By using our services, you agree to be bound by these Terms. If you do not agree, please refrain from using our services.
1. SERVICE DESCRIPTION
Eira Shipping Logistics provides the following services:
- Air Freight and Sea Freight (including express barrel shipments)
- Personal Delivery within Montego Bay and Downtown/Fair areas
- Local Pick-Up Services in Eden and Anchovy
- Personal Shopping Assistance (subject to separate agreement)
All services are offered within Jamaica, with primary operational focus on Montego Bay, Downtown/Fair, Eden, and Anchovy. International shipping is not currently offered unless coordinated through approved partners.
2. CUSTOMER RESPONSIBILITIES
2.1. Packaging: Customers must securely package all items to withstand normal handling during transport. Inadequate packaging may result in damage for which the Company assumes no liability.
2.2. Documentation: Customers must provide accurate shipping details, including full names, addresses, contact numbers, and item descriptions. False or incomplete information may delay delivery or incur additional fees.
2.3. Prohibited Items: Customers must not ship items listed in Section 6 or those restricted under Jamaican customs and postal regulations.
2.4. Compliance: Customers are solely responsible for ensuring shipments comply with all applicable Jamaican laws, including import/export and consumer safety regulations.
3. COMPANY RESPONSIBILITIES
3.1. Care Standards: We handle all shipments with reasonable care consistent with industry standards for courier and logistics service providers in Jamaica.
3.2. Delivery Commitment: We commit to delivering packages within 1–2 business days after the package status is marked “Ready for Pickup” in our tracking system.
3.3. Operating Hours: Our services operate Monday to Sunday, 8:00 AM to 6:00 PM, including public holidays and weekends, unless otherwise notified.
4. PRICING AND PAYMENT
4.1. Base Rates:
- JMD $650 per pound for the first 10 lbs
- JMD $600 per pound for weight exceeding 10 lbs
4.2. Additional Fees:
- Processing Fee: JMD $150 per package (applies to all shipments)
- Storage Fee: JMD $100 per package per day for packages not collected within 15 days of being marked “Ready for Pickup”
4.3. Payment Terms: Full payment is due at the time of service initiation (i.e., upon drop-off or scheduling of pick-up). We do not offer credit terms (e.g., Net 30).
4.4. Price Adjustments: Rates are subject to change with 30 days’ notice via our website or direct communication.
5. LIABILITY AND INSURANCE
5.1. Liability Limit: The Company’s maximum liability for loss or damage to any package is limited to JMD $5,000 per shipment, unless the Customer declares a higher value and pays for optional insurance (if offered).
5.2. Claims Process: All claims for loss or damage must be submitted in writing to [email protected] within 48 hours of delivery or scheduled delivery date. Supporting evidence (e.g., photos, receipts) must accompany the claim.
5.3. No Insurance Included: Basic service does not include insurance. Customers are encouraged to obtain independent coverage for high-value items.
6. PROHIBITED ITEMS
The following items are strictly prohibited and will not be accepted for shipment under any circumstances:
- Firearms, ammunition, and explosives
- Flammable, corrosive, or toxic substances
- Perishable food items (unless pre-approved and properly sealed)
- Illegal drugs or controlled substances
- Live animals
- Currency, jewelry, precious metals, or negotiable instruments
- Any item prohibited under the Customs Act of Jamaica, Dangerous Goods Regulations, or Postal Services Act

7. DELIVERY TERMS
7.1. Timeframes: Delivery occurs within 1–2 business days after package status changes to “Ready for Pickup.”
7.2. Failed Deliveries: If delivery fails due to incorrect address, unavailability, or refusal by recipient, the package will be held at the designated collection point for 15 days.
7.3. Storage Fees: After 15 days, a JMD $100 per day storage fee applies. Unclaimed packages after 30 days may be disposed of at the Company’s discretion.
8. FORCE MAJEURE
The Company shall not be liable for delays or failures in performance due to circumstances beyond reasonable control, including but not limited to:
- Severe weather (e.g., hurricanes, flooding)
- Government actions or customs inspections
- Port or airport closures
- Civil unrest, strikes, or pandemics
- Power or system outages
In such events, delivery timeframes will be extended reasonably, and no refunds will be issued.
9. DISPUTE RESOLUTION
9.1. Complaint Process: Customers must first submit complaints via email to [email protected]. We will respond within 5 business days.
9.2. Governing Law: These Terms are governed by and interpreted in accordance with the laws of Jamaica.
9.3. Jurisdiction: Any unresolved disputes shall be subject to the exclusive jurisdiction of the courts of St. James Parish, Jamaica.
10. PRIVACY AND DATA PROTECTION
10.1. We collect personal information (name, address, phone, email) solely for shipment processing, communication, and regulatory compliance.
10.2. We do not sell or share customer data with third parties, except as required by Jamaican law (e.g., customs declarations).
10.3. Data is stored securely in compliance with the Data Protection Act, 2020 (Jamaica).
11. MODIFICATION TERMS
We reserve the right to update these Terms at any time. Revised Terms will be posted on our website (once active) or communicated via email. Continued use of our services after changes constitutes acceptance.
12. TERMINATION CLAUSES
12.1. Customers may discontinue use of services at any time.
12.2. The Company may suspend or terminate service to any customer for:
- Repeated shipment of prohibited items
- Fraudulent activity
- Non-payment of fees
- Violation of these Terms
Outstanding fees must be settled before account closure.
13. REFUND POLICY
13.1. Refund requests must be submitted in writing within 7 days of service completion.
13.2. Refunds are not granted for:
- Delays caused by Force Majeure
- Customer-provided incorrect information
- Storage fees or processing fees already incurred
13.3. Approved refunds will be processed within 14 business days via the original payment method (if applicable) or bank transfer.
Acceptance of Terms
By using Eira Shipping Logistics services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions in full.
